State v. Freixa, 271 So. 3d 1178 (2019)

April 24, 2019 · District Court of Appeal of Florida, Third District · No. 3D18-1150
271 So. 3d 1178

The STATE of Florida, Appellant,
v.
Dolores FREIXA, Appellee.

No. 3D18-1150

District Court of Appeal of Florida, Third District.

Opinion filed April 24, 2019

Ashley Moody, Attorney General, and Natalia Costea, Assistant Attorney General, for appellant.

Carlos J. Martinez, Public Defender, and Howard K. Blumberg, Special Assistant Public Defender, and Luis A. Arguelles and Eric Rojo Dotel, Certified Legal Interns, for appellee.

Before EMAS, C.J., and SCALES, and LINDSEY, JJ.

PER CURIAM.

Affirmed. See State v. Lewars, 259 So.3d 793 (Fla. 2018) (explaining that section 775.082(9)(a)(1), Fla. Stat. (2012), unambiguously supports the conclusion that "release from a county jail does not satisfy the 'released from' element of the statute's [prison release reoffender] definition").
