Appeal pursuant to N.C.G.S. § 7A-30(2) from the decision of a divided panel of the *143Court of Appeals, ___ N.C.App. ___, 640 S.E.2d 419 (2007), affirming an opinion and award filed on 27 July 2005 by the North Carolina Industrial Commission. On 27 June 2007, the Supreme Court allowed defendant-employer's petition for discretionary review of additional issues. Heard in the Supreme Court 14 November 2007.
