The defendant's application is denied without prejudice, and the case is remanded to the Appeals Court for any reconsideration that may be warranted in light of this court's decision in Commonwealth v. Leslie, All Mass. 48 (2017). Either side is free to apply, or re-apply as the case may be, for further appellate review following the Appeals Court's reconsideration of the matter.
