App. 668, 594 S.E.2d 397 (2004), affirming an order entered by Judge Dennis J. Winner on 30 October 2002 in Superior Court, Buncombe County, dismissing plaintiff’s complaint for failure to state a claim upon which relief can be granted. Heard in the Supreme Court 7 December 2004.
