Hines v. Wood, 3 N.C. 220, 2 Hayw. 220 (1802)

Oct. 1802 · North Carolina Superior Court
3 N.C. 220, 2 Hayw. 220

Hines vs. Peyton Wood.

THIS was a special verdict which had been found about five years ago, and had been twice argued ; and now it v/as moved, upon affidavits, that the court would grant a rule to shew cause why it should not be set aside. This was strenuously opposed, on the ground, that motions for new trials should be made within the term when the verdicts were given.

Hall, Judge.

Let the motion be granted, and a rule made, returnable to next term.
