Gillie v. Moore, 193 N.C. 845 (1927)

April 20, 1927 · Supreme Court of North Carolina
193 N.C. 845

R. M. GILLIE v. J. H. MOORE, Administrator of J. M. GALLAWAY, Deceased.

(Filed 20 April, 1927.)

Appeal by defendant from Oglesby, J., at June Term, 1926, of Rockingham.

Civil action to recover tbe balance alleged to be due on an account between tbe parties, represented by orders signed by J. M. Gallaway, deceased.

From a verdict and judgment in favor of plaintiff, tbe defendant appeals, assigning errors.

Sharp & Crutchfield for plaintiff.

Junius C. Brown for defendant.

Per Curiam.

Tbe controversy on trial narrowed itself principally to issues of fact, wbicb tbe jury alone could determine. All matters in dispute have been settled by tbe verdict, and no action or ruling on tbe part of tbe trial court bas been discovered by us wbicb we apprehend should be held for reversible error. A careful perusal of tbe entire record leaves us with tbe impression that tbe case bas been tried sub-

stantially in accord with tbe principles of law applicable.

No error.
