State v. Martin.

From Northampton.

The defendant was indicted below for an assault and battery, and being acquitted was discharged; whereupon the state appealed. On the reading of the record in this Court, Mr. Attorney General gave up the cause, on the authority of State v. Taylor, (1 Hawks 462.)
