*Warrington’s case.

Warrington had execution out of this court by fieri facias of a term which was fold by the bailiff of a liberty: after which, on another judgment, the bailiff delivered the term to another, pretending that the former judgment and execution were fraudulent. And in trespass he justified.

Per Curiam.

He is no judge of the fraud. The court will not give such opportunities to sheriffs and their officers.
