THE defendant promised to the plaintiff’s attorney ex parte quarentis. (anglice,) on behalf of the plaintiff that he should pay him &c. in consideration, &c. The plaintiff brought an action on the case, and declared specially as here, but not generally of a promise made to himself. It was adjudged well. It was said it would be well either way.
