One partner cannot bind the other by bond.

THE bond upon which this action is sounded, is executed by one partner for himself and the others. He has no power, merely as a partner, to execute a bond, which shall be obligatory upon the rest of the firm. The case of Harrison versus Rushforth, in 7 Term Rep. is a conclusive authority to this effect ; and the reasoning upon which it is founded seems to be unanswerable.
