Sachs v. Sachs, 160 Ill. App. 586 (1911)

April 7, 1911 · Illinois Appellate Court · Gen. No. 17,450
160 Ill. App. 586

Marcus Sachs, Appellee, v. Simon Sachs, Appellant.

Gen. No. 17,450.

Appeals and eeboes—failure to perfect joint appeal. An appeal perfected by one defendant only, pursuant to granting of a joint appeal, will be dismissed on motion.

Appeal from the Circuit Court of Cook county; the Hon. Richaed S. Tuthill, Judge, presiding. Heard in the Branch Appellate Court at the October term, 1910.

Appeal dismissed.

Opinion filed April 7, 1911.

Brown & Navigato, for appellant.

Wheeler, Silbes, & Isaacs, for appellee.

Mr. Presiding Justice Smith

delivered the opinion of the court.

The appellee, Marcus Sachs, moves the court to affirm the decree of the court below or to dismiss the appeal for the reason that the appeal was prayed jointly by all the defendants and allowed to all the defendants, and that only one of the defendants, Simon Sachs, signed the appeal bond or perfected this appeal.

The record shows that the appeal prayed and allowed was a joint appeal by all of the defendants and that only one defendant filed the appeal bond. The appeal must therefore be dismissed. Damages to the amount of forty dollars are awarded to appellee.

Appeal dismissed.
